Agreement to our legal terms

Nanitabs (“Company,” “we,” “us,” or “our”) operates nanitabs.com and related services. By accessing the Services you agree to these terms; if you disagree, you must discontinue use. We’ll notify you of changes in advance via legal@nanitabs.com.

The Services are intended for users who are at least 13 years old. Minors need parental permission and supervision.

Our Services

The Services are not tailored for HIPAA- or FISMA-regulated use. You are responsible for complying with your local laws, and any use that would violate the Gramm-Leach-Bliley Act is prohibited.

Intellectual property rights

Nanitabs owns all content and marks, protected under copyright and trademark law.

You get a limited, non-exclusive, revocable license to use Nanitabs widgets and products for personal and content creation purposes, including monetized streams, but not for commercial redistribution, resale, or incorporation into products or services you sell.

Feedback or suggestions that enter development and are released as part of the Service become Nanitabs' property. Proper credits will always be given to the contributing user. You warrant that any submissions are lawful and non-infringing.

3. User representations

You must provide accurate registration information, be at least 13 (or have parental consent if a minor), not use bots or automation, and comply with all applicable laws.

4. User registration

You are responsible for keeping your password confidential. Nanitabs may reclaim usernames that are inappropriate.

5. Purchases and payment

We accept Visa, Mastercard, Discover, American Express, and PayPal. All payments are in Euros. Prices may change, and orders may be refused or limited at our discretion.

All sales of digital products are final — digital goods are delivered immediately and are non-refundable. Where required by law, by starting your download or accessing the product immediately you consent to immediate delivery and waive any statutory right of withdrawal.

6. Subscriptions

Subscriptions renew automatically on a monthly billing cycle. All purchases are non-refundable; cancellation takes effect at the end of the current paid term, and fee changes will be communicated as required by applicable law.

7. Software

Software is provided “as is” without warranty, governed by an accompanying EULA if one is provided, otherwise by a limited personal license.

8. Prohibited activities

You may not:

Re-sell, redistribute, edit or transfer the product or license.
Use, train, or reproduce our work with AI or machine-learning tools, regardless of whether you are a user, competitor or third-party service.
Initiate chargebacks or unauthorized refund requests. This will result in immediate revocation of access and a permanent ban from the Service.
Scrape data, circumvent security, harass others, spam, impersonate, reverse engineer, use unauthorized automation or bots, resell accounts, or use the Services to compete with us.

11. Third-party platforms and content

If you link third-party accounts, you warrant that you have the right to share that access. Your relationship with those platforms is governed by your own agreements with them. Nanitabs is not responsible for third-party sites or content linked from the Services; you use them at your own risk.

13. Services management

Nanitabs may monitor for violations, restrict contributions, remove burdensome content, and take legal action as needed.

14. Privacy policy

The Services are hosted in the United States. By using them you consent to your data being transferred and processed there in accordance with our Privacy Policy.

15. Term and termination

Nanitabs may deny access or terminate accounts at its sole discretion, without notice, for any reason, including violation of these terms, disrespectful behavior, or filing unauthorized chargebacks. Upon termination, your license to use the Service ends immediately and no refunds will be issued for any unused portion of a purchase.

Users may also request full deletion of their account and associated data by contacting privacy@nanitabs.com.

16. Modifications and interruptions

Nanitabs may change, discontinue, or correct the Services at any time without notice and without liability for any resulting loss or inconvenience.

17. Governing law

These terms are governed by the laws of Portugal (excluding the UN Convention on Contracts for the International Sale of Goods). EU consumers retain the protections of their home country, with non-exclusive jurisdiction in the courts of Lisbon.

18. Dispute resolution

Disputes begin with 30 days of informal negotiation, followed by binding arbitration under the European Court of Arbitration rules, seated in Lisbon and conducted in English. Class actions are waived. Certain disputes — intellectual property, theft, privacy, and injunctive relief — are excluded from arbitration.

20. Disclaimer

The Services are provided “as is” and “as available.” All warranties are disclaimed to the fullest extent permitted by law, including any liability for content errors, security breaches, interruptions, or third-party products and services.

21. Limitations of liability

Nanitabs is not liable for indirect, consequential, or punitive damages. Liability is capped at the amounts you paid us in the preceding 12 months. Some jurisdictions may not allow these limitations.

22. Indemnification

You agree to indemnify Nanitabs against claims arising from your use of the Services, breach of these terms, or violation of third-party rights.

23. User data

Nanitabs performs routine backups, but you are responsible for maintaining your own data. We accept no liability for data loss.

26. Miscellaneous

Standard entire-agreement, severability, no-waiver, assignment, and force-majeure clauses apply. These terms create no joint venture, partnership, or employment relationship. You consent to electronic communications and agree that electronic signatures satisfy legal writing requirements.
